You have complete control over what you download and whatever modem you use, and the cable providers have no authority over this.
When not utilising the proper protocols, it may not function, but they will not disqualify those that do work in this case.

In most circumstances, it takes years for a technology to become available and mature in the marketplace - often as long as three to five years.
Even if 15 to 20% of the market adopts DOCSIS 3.1 in the first or second year, that still leaves 80 percent of the market without it.
Future-proofing your technology is a good thing, but it's also important to have a sense of proportion while doing so.
I went to the ARRIS SB6183 with the knowledge that my Internet service provider provides 200 Mbps.
It provides a significant amount of breathing room for expansion.
If my ISP's average speeds increased to 500 Mbps and I were to consider another cable modem upgrade, I would look for a faster cable modem that uses the DOCSIS 3.1 standard, or any newer and more powerful standard, which would allow me to benefit from the latest standards and speeds while maintaining my current speeds.
In two to three years, the DOCSIS 3.0 standard may be reaching the end of its useful life.
As a result, I do not see the benefit of upgrading to a 1.4 Gbps DOCSIS 3.0 modem.
